Anti-Spam & Communications Policy

1. Purpose
Incedo Inc. (“Incedo”, “we”, “us”, or “our”) is committed to maintaining transparent, respectful, and lawful communication with our users, clients, and partners. This Anti-Spam & Communications Policy explains:
- How we send marketing and service communications.
- Your choices to manage or opt out of communications.
- How we comply with global anti-spam and data protection laws.
2. What We Mean by “Spam”
“Spam” refers to any unsolicited, bulk, or irrelevant messages sent electronically, including email, SMS, chat, or social media messages.
Incedo has a zero-tolerance policy towards spam:
- We do not send unsolicited messages to individuals who have not provided consent or with whom we do not have a legitimate business relationship.
- We do not purchase, rent, or trade email lists from third parties.
3. Types of Communications We Send
(a) Transactional / Service Communications
These are essential communications relating to your use of our services. Examples include:
- Account creation confirmations
- Security alerts or password resets
- Transaction receipts and billing notices
- Service updates or changes
Please Note: – These cannot be opted out of, as they are necessary for service delivery.
(b) Marketing Communications
These are optional and sent only when you:
- Provide explicit consent (EU/UK GDPR, India DPDPA).
- Have an existing client relationship where relevant (legitimate interest under GDPR/UK law).
Examples include:
- Newsletters
- Event invitations and webinar promotions
- Product updates and thought-leadership content

4. Consent and Opt-Out Mechanisms
- Consent (Opt-in):
- In the EU, UK, and India, marketing communications are only sent when users opt-in.
- Consent is specific, informed, and freely given (no pre-checked boxes).
- Opt-out / Unsubscribe:
- Every marketing email contains a clear “Unsubscribe” link.
- Opt-out requests are processed within 10 business days (CAN-SPAM compliance).
- In SMS/WhatsApp campaigns, you may reply “STOP” to opt-out.
- CCPA/CPRA Compliance (California):
- California residents can exercise “Do Not Sell or Share My Personal Information” rights regarding marketing data.
5. Responsible Email Practices
We commit to:
- Including our company name, physical mailing address, and valid contact details in every marketing communication.
- Clearly identifying commercial messages as “advertising” where required by law.
- Avoiding misleading subject lines, headers, or “from” names.
- Maintaining accurate mailing lists — promptly removing bounced, inactive, or unsubscribed addresses.
6. Third-Party Marketing Tools
We may use third-party email and marketing automation platforms (e.g., Mailchimp, HubSpot, Salesforce). These providers act as our data processors and must comply with data protection and anti-spam laws.
We do not authorize third parties to send spam on our behalf.
7. Data Protection and Privacy
All marketing communications are governed by our Privacy Policy and Cookies Policy, which explain:
- What personal data we collect for communications.
- How long we retain it.
- How you can exercise your rights (access, deletion, objection, portability).
8. Reporting Spam or Abuse
If you believe you have received spam or unwanted communication from Incedo:
- Forward the message to abuse@incedoinc.com.
- Include details (headers, screenshots) to help us investigate.
We investigate all complaints and take corrective action, including removal of the recipient’s data from our lists.
9. Penalties for Non-Compliance
Violations of anti-spam laws can result in regulatory fines (e.g., up to $43,792 per email under U.S. CAN-SPAM, or €20 million / 4% of annual turnover under GDPR).
Accordingly, we require all employees, contractors, and marketing vendors to strictly follow this Policy.
10. Updates to This Policy
We may update this Policy from time to time to reflect legal, technological, or operational changes. Updated versions will be posted here with a revised “Last Updated” date.
11. Governing Law
This Policy and any disputes arising under it shall be governed by the laws of the State of New Jersey, United States, without regard to its conflict of laws principles.
Any disputes shall be resolved exclusively in the state or federal courts of New Jersey, USA.
